Climate and Coverage Context
New York's climate puts both heating and cooling under strain, in our reading
Temperatures in New York have risen almost 2.5 degrees F since the early 1900s, with the warming concentrated in winter and spring. Summer warming is driven more by warm nights than by very hot days, and very cold nights have become less frequent. Heavy rain events have increased and further increases are projected, with a higher risk of springtime flooding.
Both systems get real use here, so look for a plan that covers heating and cooling and compare its cap with your own replacement quote.

How New York Regulates Home Warranties
Regulator
New York Department of Financial Services (DFS)
Legal framework
Service contracts under Article 79 of the Insurance Law
New York's Insurance Law Article 79 regulates service contracts. Section 7902 defines a service contract as an agreement, for extra consideration and a set term, to repair, replace or maintain property or to indemnify for those costs. Department of Financial Services opinions say a home warranty sold by a company outside the chain of sale generally must be registered with the Superintendent as a service contract provider, that the provider must show financial responsibility (a funded reserve with a security deposit, a net worth of at least $100 million, or reimbursement insurance), that contracts and rates are not filed with the Department, and that maintenance agreements fall outside Article 79. Section 7905(j) requires each contract to state its transfer terms. The opinions date from 2000 to 2008, and whether a particular home product is a warranty or a service contract depends on its terms, so ask the Department about a specific company.
Type of rules: Home-specific rules. A law or program that names home warranties, home service contracts or residential service contracts.

Consumer Tips for New York Homeowners
Check the company's registration or license
Our sources show rules in New York that name home warranties, home service contracts or residential contracts. Ask the New York Department of Financial Services whether the company you are considering is registered or licensed before you pay.
Do the cap math for your own system
Get a replacement quote from a local HVAC contractor, then enter it in the calculator above. Our top-ranked option here, AFC Home Club, has an HVAC cap of No cap; the difference between your quote and each company's cap is your out-of-pocket cost if the system fails completely. Details
Know the renewal rule
New York's General Obligations Law section 5-903 makes an automatic renewal clause in a service, maintenance or repair contract unenforceable unless the provider sends written notice, served personally or by certified mail, 15 to 30 days before your deadline to give notice of non-renewal. Details
Know the transfer rule
New York's Insurance Law section 7905(j) requires a service contract to state the terms that govern its transfer, so check how and whether yours can pass to a buyer. Details
Confirm coverage for your address
4 companies in our data serve only some states and are marked "check availability" for New York. Confirm with the company that your address is covered before you spend time on a quote.
Filing a Complaint in New York
If a company denies a claim you think is valid or stops responding, put your complaint to the company in writing first. New York's state office below takes consumer complaints about businesses in general, so it is a place to file a home warranty dispute, but it is not a home warranty regulator by that fact alone. Who regulates the contract is covered in the regulation section above.
