Home warranty service contract statutes, outside the insurance code
Colorado regulates home warranty service contracts under Part 9 of Article 10 of Title 12, the real estate title, and the insurance code's service contract part exempts them. The statutes set contract content rules, such as listing excluded items and the exact termination date, and say these contracts are not insurance. A Division of Real Estate spokesperson told Denver7 there is no regulatory program for them, while the statutes require contracts to disclose that consumers may have rights under the Colorado Consumer Protection Act. A 2020 bill set the statutes to be reviewed in 2026, and we did not confirm what happened.
