Climate and Coverage Context
New Mexico's climate puts both heating and cooling under strain, in our reading
Most of New Mexico is arid to semiarid, and most areas in the central and western parts get less than 15 inches of precipitation a year; summer precipitation comes mainly from the monsoon. Monthly averages in the northern mountains run from the low 20s F in January to around 60 F in July; in the lower elevations of the south they run from the mid 40s F in January to the low 80s F in July. The state has warmed by more than 2 degrees F since the early 1900s, the last decade was the warmest on record, and hot days and warm nights are increasing.
Both systems get real use here, so look for a plan that covers heating and cooling and compare its cap with your own replacement quote.

How New Mexico Regulates Home Warranties
Regulator
New Mexico Office of Superintendent of Insurance (OSI)
Legal framework
Service Contract Regulation Act (NMSA 59A-58)
New Mexico regulates service contracts, including residential system and appliance contracts, under the Service Contract Regulation Act. OSI's guidance says a provider must register with OSI before it issues, sells or offers a service contract in the state. The enacted 2001 bill lets the superintendent require a deposit such as a surety bond, and it says a service contract is void and the price refundable if the holder has made no claim and returns the contract. Service contracts are generally outside the New Mexico Insurance Code, so a provider does not need an insurance license. We did not find an OSI rule written specifically for home warranty companies.
Type of rules: Home-specific rules. A law or program that names home warranties, home service contracts or residential service contracts.
Checked against the official sources listed below. Researched October 2026; laws and agency pages change, so confirm with the regulator before you rely on a detail.

Consumer Tips for New Mexico Homeowners
Check the company's registration or license
Our sources show rules in New Mexico that name home warranties, home service contracts or residential contracts. Ask the New Mexico Office of Superintendent of Insurance whether the company you are considering is registered or licensed before you pay.
Do the cap math for your own system
Get a replacement quote from a local HVAC contractor, then enter it in the calculator above. Our top-ranked option here, AFC Home Club, has an HVAC cap of No cap; the difference between your quote and each company's cap is your out-of-pocket cost if the system fails completely. Details
Know the return right
New Mexico's Service Contract Regulation Act voids the contract and requires a refund of the price if you have made no claim and return the contract. Details
Confirm coverage for your address
5 companies in our data serve only some states and are marked "check availability" for New Mexico. Confirm with the company that your address is covered before you spend time on a quote.
Filing a Complaint in New Mexico
If a company denies a claim you think is valid or stops responding, put your complaint to the company in writing first. New Mexico's state office below takes consumer complaints about businesses in general, so it is a place to file a home warranty dispute, but it is not a home warranty regulator by that fact alone. Who regulates the contract is covered in the regulation section above.
New Mexico Department of Justice: submit a complaint
The Department of Justice's online form asks for the parties, the complaint details and up to five documents. Submitting a complaint is not confirmation that an investigation will start.
This paraphrases the office's own page as found in October 2026. Offices change their forms and procedures, so confirm on the page before you file.
