Climate and Coverage Context

Virginia's climate puts both heating and cooling under strain, in our reading

Virginia has a humid climate with hot summers and moderately cold winters; statewide averages run from about 35 F in January to about 75 F in July. Summer average temperature has been the warmest on record since 2005, and the state has warmed by more than 1.5 degrees F since the early 1900s. Annual precipitation is under 40 inches in parts of the central mountains and around 50 inches on the tidewater coast, and extreme heat and extreme precipitation events are projected to increase.

Both systems get real use here, so look for a plan that covers heating and cooling and compare its cap with your own replacement quote.

How Virginia Regulates Home Warranties

Regulator

Virginia Department of Agriculture and Consumer Services (Commissioner of Agriculture and Consumer Services); Attorney General for consumer complaints

Legal framework

Home Service Contract Providers (Va. Code 59.1-434.1 and following)

Virginia regulates home service contract providers under Chapter 33.1 of Title 59.1 of the Code (sections 59.1-434.1 and following), which is administered by the Commissioner of Agriculture and Consumer Services, not the Bureau of Insurance. Providers register with the Commissioner (section 59.1-434.2). The Code defines a home service contract as a contract for a separately stated price, for any duration, to perform the service, repair, replacement or maintenance of property, or to indemnify the cost of it, after an operational failure from a defect in materials or workmanship, an inherent defect or normal wear and tear. Section 59.1-434.7 says home service contracts are not contracts of insurance and are not regulated under Title 38.2, and a provider with a net worth above $100 million is exempt from the chapter. Title 38.2, Chapter 26 keeps a separate framework for home protection insurance contracts.

Type of rules: Home-specific rules. A law or program that names home warranties, home service contracts or residential service contracts.

Consumer Tips for Virginia Homeowners

Check the company's registration or license

Our sources show rules in Virginia that name home warranties, home service contracts or residential contracts. Ask the Virginia Department of Agriculture and Consumer Services whether the company you are considering is registered or licensed before you pay.

Do the cap math for your own system

Get a replacement quote from a local HVAC contractor, then enter it in the calculator above. Our top-ranked option here, AFC Home Club, has an HVAC cap of No cap; the difference between your quote and each company's cap is your out-of-pocket cost if the system fails completely. Details

Know the renewal rule

Virginia Code section 59.1-207.46 requires an automatic renewal offer to be presented clearly before you are bound, requires your consent before you are charged, and requires a renewal notice that states the cancellation deadline and method. Details

Confirm coverage for your address

4 companies in our data serve only some states and are marked "check availability" for Virginia. Confirm with the company that your address is covered before you spend time on a quote.

Filing a Complaint in Virginia

If a company denies a claim you think is valid or stops responding, put your complaint to the company in writing first. Virginia's state office below takes consumer complaints about businesses in general, so it is a place to file a home warranty dispute, but it is not a home warranty regulator by that fact alone. Who regulates the contract is covered in the regulation section above.

Virginia Attorney General: file a complaint

The Consumer Protection Section handles goods and services meant for personal, family or home use. It does not handle transactions between private individuals or products for business use, and a printed form must be signed or it is returned.

This paraphrases the office's own page as found in October 2026. Offices change their forms and procedures, so confirm on the page before you file.
