Kentucky's Department of Insurance requires makers of non-automobile service contracts, which the regulation calls service contracts for consumer products, to register under 806 KAR 5:060, which implements KRS 304.5-070(1)(q). A maker shows financial security with a net worth of at least $100 million or an insurance policy or performance bond for $50,000 or 25 percent of its annual revenue from Kentucky service contracts, whichever is greater, and updates its registration each year. A 2016 act (Senate Bill 58) says a consumer product service contract is not insurance if the maker registers and provides the required evidence. We did not confirm that a home warranty is a consumer product service contract in the regulation's terms, so ask the Department.
